A federal judge on Friday ordered Volkswagen to pay $2.8 billion in criminal penalties after the automaker admitted last month to illegally calibrating diesel engines so they could get around USA pollution rules.

"This is a case of deliberate massive fraud perpetrated by VW management", Judge Sean Cox said during the sentencing hearing in Detroit.

Neal disclosed that a former Justice Department official, Larry Thompson, will serve as a monitor to ensure that VW complies with the plea agreement, which includes three years of probation and complete future cooperation with any inquiries by investigators.

In brief remarks to the judge, VW defense attorney Jason Weinstein says the criminal fine is an "appropriate and serious sanction".

Lawyers for the U.S. Department of Justice had argued a month ago that the $4.3 billion settlement was adequate even though it was only a fraction of the penalty that U.S. law allowed. Volkswagen engineer James Liang pleaded guilty to charges of fraud by concealing emission test rigging software from United States regulators. Regulators have said that in normal driving they emitted up to 40 times more smog-causing nitrogen oxide than the legal limit.

Volkswagen's criminal penalty for its emissions scandal is getting closer to reality.

Before issuing a sentence, Cox was expected to have considered an objection filed by an attorney for victims in the emissions cheating scandal. Volkswagen has pledged to develop more battery-powered vehicles in the coming years.

Since the September 2015 disclosure that VW intentionally cheated on emissions tests for at least six years, the company has agreed to spend up to $25 billion in the United States to address claims from owners, environmental regulators, states and dealers and to make buy-back offers. "This case also involves a failure of the VW supervisory board, which is government, labor and shareholders".

The district court judge in Detroit also placed the German auto maker on three years of probation, settling the U.S. criminal case over the scandal that has roiled the firm since 2015.

Judge Cox refused to release Schmidt on bond, agreeing with prosecutors that he risked fleeing to Germany, which does not extradite its citizens.
