43 states reach $33M settlement with Johnson & Johnson

The states alleged that Johnson & Johnson subsidiary McNeil-PPC committed consumer fraud by selling drugs that it falsely claimed were manufactured following federal practices.

The settlement resolves allegations that Defendants acting through McNeil unlawfully promoted their OTC drugs as complying with federally mandated current Good Manufacturing Practices (cGMP) even though the FDA found that some McNeil manufacturing facilities did not comply with cGMPs between 2009 and 2011.

The settlement prohibits McNeil from stating its facilities meet federal standards within 12 months of a recall, according to a news release from the West Virginia Attorney General's office.

MA will get $900,000 in a settlement resulting from an investigation into New Jersey home health product giant Johnson & Johnson's alleged misrepresentation of the quality of certain over-the-counter drugs.

Beshear's office said the alleged lapses resulted in recalls of numerous drugs.

Class I recalls involve a reasonable probability that use or exposure to the drug may result in serious detrimental health consequences or death.

"This is common sense", Attorney General Eric Schneiderman of Consumerist's home state of NY said in a statement sent this afternoon.

Attorneys general from Pennsylvania and Texas led the litigation.
