The 2013 photo of Swift, Mueller and Mueller's girlfriend taken at the pre-concert event in Denver is a key piece of evidence in Mueller's suit claiming he was sacked after being falsely accused by Swift. He then sued Taylor for defamation while she filed a counter-claim of physical assault.

During Mueller's statements, Swift's mother Andrea became visibly tearful.

Swift's business manager, Jesse Schaudies Jr., said her side did not want the picture in the news. "Grabbing a woman's rear end is an assault, and it's always wrong. Any woman - rich, poor, famous or not - is entitled to not have that happen". Mueller was dismissed after being accused of grabbing the buttocks of the singer before a 2013 Denver concert.

Baldridge also suggested that Mueller had rendered himself unemployable by publicizing the incident with Swift.

Mueller did not sue his station KYGO or its parent company Lincoln Financial Media Co. of Colorado, after he was sacked June 4, 2013.

Swift is countersuing, claiming sexual assault.

Swift and Mueller are both expected to testify in the case, along with Mueller's former boss and members of Swift's entourage.

The singer's lawyer, Douglas Baldridge, attacked the credibility of former Denver DJ David Mueller on Tuesday, asking jurors: "What's wrong with this picture?" She says she is only seeking $1.

Mueller and Swift's lawsuits were then combined to be part of the Denver-based trial, which began on Monday. Swift's attorneys have pointed to that as evidence of the inappropriate touching, and noted that KYGO cited the photo as one reason for his termination.

He had also destroyed taped conversations about the incident with his bosses, said the lawyer.

Jurors hearing the case were picked earlier in the day from a pool of 16 prospective jurors.

Swift, 27, could take the stand to give details of the alleged assault during a meet and greet four years ago.

Swift's lawyers said she was "absolutely certain" that it was Mueller who touched her. "It's not ruffled, rumbled, affected in any form or fashion".

Baldridge will continue cross examining Mueller on Wednesday.

Instead, he is seeking $3-million (R40.25-million) in lost wages and future income from Swift, alleging her complaint led to his unfair dismissal.
