Nick Xenophon Now Embroiled In Section 44 Dual Citizenship Drama

Australia's constitution bans dual citizens from parliament on the basis that lawmakers should be loyal exclusively to the country in which they were elected.

South Australian senator Nick Xenophon, says he is now checking whether he may be a British citizen due to his father's nationality.

"This really is turning into a train wreck for the federal parliament", Xenophon said at a press conference on Friday morning.

Australian politicians are not allowed to hold dual citizenship.

"I am doing all I can to clarify and sort it out".

The Turnbull government risks losing another Cabinet minister, deepening the citizenship crisis engulfing the Parliament, with Nationals deputy leader Fiona Nash revealing she is a British citizen.

The Nationals' Matt Canavan and Barnaby Joyce, along with One Nation senator Malcolm Roberts, have also been referred but have chose to remain in the parliament, pending the court's decision. She joins her Nationals colleagues after two Greens senators - Larissa Waters and Scott Ludlam - resigned and One Nation's Malcolm Roberts was referred to the High Court over his status.

Section 44 (Disqualification) states that any person who "is under any acknowledgment of allegiance, obedience, or adherence to a foreign power, or is a subject or a citizen or entitled to the rights or privileges of a subject or a citizen of a foreign power... shall be incapable of being chosen or of sitting as a senator or a member of the House of Representatives".

"It's been around for 116 years but it seems the law is still evolving". Senator Xenophon was born in Australia in 1950, and questions are being asked as to whether he has inherited British citizenship through his dad. Presumably Ms Nash will join the other five cases once Parliament resumes.

If the lawmakers under a citizenship cloud are ruled ineligible by the High Court, there would need to be by-elections in their constituencies.

The crisis kicked off in July when a minor Greens party senator stood down after revealing he had New Zealand citizenship.
