The Securities and Exchange Commission filed a complaint against Musk on Thursday, alleging he falsely claimed in an August 7 tweet that he had secured financing to buy out Tesla and take it private at $420 per share, a substantial premium over the stock price at the time.

The prospect of having the fraud charges and Musk's potential departure hanging over Tesla led to an immediate 12 percent drop in the company's share prices today.

General Motors reclaimed its crown as the most-valuable American automaker on Friday after Tesla shares plunged more than 13% in the wake of the Securities and Exchange Commission's lawsuit against CEO Elon Musk.

It's not clear whether Musk and Grimes are still together, but the two apparently unfollowed each other on Instagram at the end of last month.

"There's a ton of risk for the stock because the Tesla story is all about continuing to gain access to the capital markets", Whiston said. By August 25 Tesla announced it wouldn't go private, with Musk stating although shareholders broadly supported the move, there was "no proven path for most retail investors to own shares if we were private". The tech executive warned last June that Tesla shorts had "about three weeks before their short position explodes".

Elon Musk is being sued by the SEC for securities violations, but it appears this entire situation could have been avoided on two distinct opportunities.

Doug Davison, a partner at Linklaters and former SEC official, pointed out that billionaire investor Mark Cuban successfully fought insider trading charges from the SEC a few years back. Tesla's board backed Musk, saying that it is "fully confident" in him. Analysts have expected Tesla to raise fresh money by selling new shares.

It is still possible Musk will settle with the SEC later, said Charles Elson, director of the Weinberg Center for Corporate Governance at the University of Delaware. Johnson believes Musk's ability to inspire investors with a vision of a brighter future has blinded them to the "horrendous" fundamentals at Tesla. Musk said he was "deeply saddened and disappointed" by this "unjustified action". Stock prices rose almost nine percent following Musk's announcement of securing privatization funding, resulting in the SEC opening an investigation to ensure that the CEO was in accordance with his legally required fiduciary duties. The company has said Musk is an engaged and thoughtful leader who remains more than capable for the job.

However, Musk's lawyer reportedly called the SEC and told them that his client was no longer interested in settling.

Employees in the California offices of Tesla and SpaceX said the SEC case had further weakened morale and distracted from their already gargantuan tasks: meeting Musk's hyper-ambitious expectations for revolutionizing driving and space travel.
